logo To District Attorney Gil Garcetti: Education Code Section 7054 Violations

May 5, 1998

Dear Mr. Garcetti:

We are forwarding, by U.S. mail, a file of information relating to our allegations as to two specific violations of the captioned California Department of Education Code, as recommended to us by Deputy Attorney General Michael D. O'Reilley.

Our organization, The Conservative Order of Good Guys (C.O.G.G.) is a Political Action Committee established in September 1978 and registered as a Federal and State of California PAC.

We request that these allegations be investigated and that appropriate action, as specified in 7054 (c) of the Code be taken should the question of fact indicate that subdivision (b) (2) has been violated.

Since "The provisions of this article shall supersede all provisions on this subject in any city, county, or city and county charter as well as in the general law of this state", the argument put forth by Lennox school district Superintendent McDaniel that Section 38131 is permissive in this situation, is irrelevant since 7054 is controlling.

We will appreciate your consideration in this matter and will cooperate with you in whatever way necessary to resolve this issue.

Very truly yours,

Fred J. Ferrazzano,
C.O.G.G. Chairman of the Board
