Dear Duke:

This is our formal request for information along the lines of a question given to you when you kindly served as speaker at C.O.G.G.'s recent luncheon meeting.

We regard the Kyoto global warming treaty as a junk science product which poses a major threat to our economy as well as to U.S. Sovereignty generally. We believe that President Clinton realizes there is virtually no chance of the U.S. Senate now ratifying that treaty.

However, because of past experience, we wish to see safeguards against his possible attempts to get the separate components of that treaty implemented in piecemeal fashion by means of Executive Orders and by means of agreements with various United Nations subsidiaries.

We are therefore asking if you can furnish us with the legal boundaries that must apply to Executive Orders and with the legal remedies that can be enforced when Executive Orders are issued that exceed those boundaries.

Along similar lines we are asking if you can furnish us with the legal limits and legal remedies regarding possible binding agreements made below treaty level with the various United Nations subsidiaries, such as UNESCO, UNDP, various U.N. Covenants, U.N. Conferences, etc., without such agreements being subject to Congressional approval.

We realize you are in a position to document the federal laws that apply to these limitations that we are seeking to ascertain, and we will appreciate your help in providing us with this pertinent information.
