Dear Duke:

In our letter to you of January 16, 1998, we requested information concerning the legal limits that apply to Executive Orders and to U.N. agreements at sub-treaty levels made without Congressional approval. We are anxiously awaiting your response. Those problems that concerned us have continued to grow.

Bill Clinton's most recent relevant action that prompted our request at that time was his personal decree that nearly two million acres of Utah are declared off-limits to humans. Since then he has personally placed a ban on various so-called "assault weapons" without any action through Congress.

While on his recent trip to Africa, he personally gave away two 65-ft. Navy patrol boats to the Navy of Ghana even though the Pentagon had previously transferred legal title to those boats to the state of California.

Further, while Loral Space and Communications was under investigation by a federal grand jury regarding their possibly illegal provision of advanced missile guidance technology to the Communist Chinese, Bill Clinton personally provided the company with a waiver to exempt them from prosecution. Again, this was also done without any Congressional action. But there was action from Loral executives consisting of hundreds of thousands of dollars contributed to the Democrat party!

We have neither heard anything from Congress that would express meaningful concern of this overreaching on the part of the chief executive nor witnessed any attempt to counteract these outrageous, unilateral activities. We can hardly believe that after more than 200 years since we established a balance of powers' system, there are no laws through which Congress can prevent or reject such imperial decrees. Are there no limits upon Executive Orders? Where are the checks and balances? We will appreciate it if you or your staff will invite our attention to any laws that apply to these apparent usurpations of Congressional power.
